The federal justice ministry changed the spec on 31 March 2025 and let old forms run until 31 July 2026 — sixteen months of notice. Berlin procured the new envelopes on time; they were gone in two weeks, and the reorder failed on supplier shortages. Let us give the conclusion first, because the conclusion is bizarre enough on its own.

In Berlin, Germany, a group of people who had been sentenced to actual prison time and were due to report stayed at home for a considerable period.

They had not fled, they had not won an appeal, and there was no judicial dispute of any kind.

Berlin's prosecutors could not get them into prison for one reason only: there were no envelopes.

To understand why that is not a joke, you first need to know how formal service works in Germany.

In Germany, one class of legal document cannot be put in an ordinary envelope and posted.

Court judgments, summonses, seizure orders, and the enforcement summons telling someone when to report to prison all belong to that class.

They have to go into a yellow envelope of a specific specification, sent through the formal service procedure.

The yellow envelope here is a procedural step with legal force; its role goes well beyond decoration.

Procedurally it establishes one thing: this document has been served in accordance with the law, and the recipient cannot claim not to have received it.

Which means the whole chain is rigid.

With no yellow envelope, the document cannot be formally served.

If it is not served, the person does not, in law, know what day they are supposed to report.

And if they do not know, there is no question of consequences for not reporting.

The origin of all this was an extremely minor format change.

At the end of March last year, the German federal justice ministry revised the rules for service documents.

The new service form and envelope gained one additional tick box, and nothing else.

The change was published at the beginning of April last year, along with a generous transition period.

The old forms could be used right up to the thirty-first of July this year.

From publication to deadline, that is roughly sixteen months.

For an adjustment that amounts to swapping out a consumable, that is a very comfortable window.

And Berlin did prepare.

Before the new rule took effect on the first of August, both the new forms and the matching new yellow envelopes had been procured.

In other words, on every step where they could have been blamed, they made no mistake.

The failure happened in the one square nobody was watching.

The new envelopes they had procured were used up two weeks after they went into service.

Actual consumption was far higher than the estimate made at the time of purchase.

By any normal logic, you simply reorder at this point.

But this time the reorder failed: the supplier was equally short, and new orders could not be delivered in time.

So Berlin's justice system jammed in a fairly absurd position.

The judgments had taken effect and every legal step had been completed.

The prison had empty beds and the enforcement office was working normal hours.

The only place the whole machine stopped was that the letter telling a person to report could not get out the door.

A spokesman for Berlin's general prosecutor's office later confirmed to the press that this was a short-term supply interruption.

More envelopes were indeed supplied afterwards.

But the internal staff put it more bluntly: it is still not enough.

As for how many sentenced people had their imprisonment delayed as a result, the answer is that nobody knows.

The prosecutors never compiled the figure.

This is worth telling because it demonstrates a very typical, and very easily underestimated, kind of systemic failure.

Take the system apart and inspect it, and you will not find a single damaged component.

The law is valid, the judgment is clear, the prison has capacity, the staff are at their desks, the budget is fine, and nobody was negligent.

What it lacked was a paper bag costing a fraction of a cent.

There is a structural contradiction here worth spelling out on its own.

The more formal a procedure is, the less any one of its steps can be substituted.

The yellow envelope has legal force precisely because no other envelope has legal force.

That exclusivity is the entire source of its value.

And that same exclusivity is what left the whole chain without any alternative the moment supply ran out.

Use an ordinary envelope and the procedure does not hold; do not send it, and the procedure stops where it stands.

A sixteen-month transition period was punched straight through by two weeks of real consumption.

What was actually overestimated was their sense of their own usage; the time, if anything, was plenty.

If someone gave you sixteen months right now to finish one apparently effortless task, in which month would you actually start?
