1. Agreement

These Terms of Service ("Terms") govern your access to and use of Fluentide ("Fluentide", "we", "us"), available at https://fluentide.com and any related apps. By creating an account, listening to an episode, or otherwise using Fluentide, you agree to these Terms. If you do not agree, do not use Fluentide.

2. What Fluentide Is

Fluentide is an AI-powered Chinese listening practice platform. We generate podcast-style episodes from real news and topics using large language models and text-to-speech, calibrated to four proficiency levels. Episodes include scripts, pinyin, English translations, vocabulary, and grammar notes. Fluent Score and placement quizzes help track your progress over time.

3. Eligibility

You must be at least 13 years old to use Fluentide. If you are under the age of majority in your jurisdiction, you may use Fluentide only with the consent of a parent or legal guardian. By using Fluentide you represent that you meet these requirements.

4. Accounts

You are responsible for the accuracy of your account information and for keeping your login credentials secure.
You are responsible for activity that occurs under your account.
One person, one account. Do not share accounts or use someone else's account.
We may suspend or terminate accounts that violate these Terms or that are used to abuse the service.

5. Free Tier and Subscriptions

Fluentide offers a limited free tier and paid subscriptions:

Anonymous visitors can listen to 2 free episodes.
Signed-in users get 1 additional free episode (3 total).
Beyond the free tier, a subscription is required for unlimited listening, pinyin, translations, vocabulary and grammar breakdowns, and access to all proficiency levels.

Current plans are $4.99/month (Student), $9.99/month (Pro), and $59.99/year (Yearly). Prices are subject to change; we'll give existing subscribers reasonable notice before any price increase takes effect on their plan.

6. Billing and Renewal

Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.
Subscriptions renew automatically at the end of each billing period (monthly or yearly) until cancelled.
You can cancel any time from your account settings or by contacting us. Cancellation stops the next renewal; access continues through the end of the current paid period.
Taxes may apply based on your location and are added at checkout where required.

7. Refunds

We don't offer refunds for partial billing periods. If you believe you were charged in error, or if Fluentide was materially broken for an extended period during your subscription, email us at support@fluentide.com and we'll review your request in good faith. Mandatory refund rights under the consumer-protection laws of your jurisdiction (for example, the EU 14-day right of withdrawal where applicable) are not affected by this policy.

8. AI-Generated Content

Episodes, scripts, translations, pinyin, vocabulary, and grammar notes on Fluentide are generated using AI models and automated pipelines. We review for quality, but:

Content may contain factual inaccuracies, translation errors, or unnatural phrasing.
News-based episodes summarize publicly reported events; we are not the original news source and do not guarantee that every detail is current or accurate.
Fluentide is a learning tool, not a substitute for professional translation, legal, medical, or financial advice.

Use Fluentide's output with judgement. If something looks wrong, please tell us.

9. Intellectual Property

Fluentide, including the platform, branding, mascot, and the AI-generated episodes and supporting materials produced by us, is owned by Fluentide or its licensors and is protected by copyright and other laws.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Fluentide for your own language-learning purposes while your account is in good standing. You may not:

Copy, redistribute, or republish episode audio, scripts, or translations as your own work.
Scrape Fluentide at scale, train your own models on Fluentide content, or resell access.
Remove or obscure attribution, trademarks, or notices.

Quoting short excerpts (e.g. a sentence in a blog post or screenshot in a review) with attribution to Fluentide is fine.

10. Acceptable Use

You agree not to:

Use Fluentide for anything illegal, harmful, or that infringes on others' rights.
Attempt to gain unauthorized access to the service, other accounts, or our infrastructure.
Probe, scan, or test the vulnerability of the service or break any security or authentication measures.
Use bots, crawlers, or automated tools to access or copy Fluentide content beyond what robots.txt explicitly permits.
Interfere with or disrupt the service or the experience of other users.

11. Third-Party Services

Fluentide relies on third-party providers to operate (Supabase, Stripe, Cloudflare, Vercel, Resend, Microsoft Clarity, Google OAuth, OpenRouter, MiniMax, and others described in our Privacy Policy). Their services are governed by their own terms, and their availability is outside our control.

12. Service Availability and Changes

We work to keep Fluentide running smoothly but do not guarantee uninterrupted or error-free service. We may add, change, or remove features, episodes, or proficiency levels at any time. We may also suspend the service for maintenance or other operational reasons.

13. Termination

You can stop using Fluentide and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, abuse the service, or if required by law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

14. Disclaimer of Warranties

Fluentide is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, secure, or error-free. Your use of Fluentide is at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, Fluentide and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of Fluentide. Our total liability for any claim relating to Fluentide will not exceed the amount you paid to us in the 12 months immediately preceding the event giving rise to the claim, or USD $50, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold Fluentide and its operators harmless from any claim, demand, or damages arising out of your breach of these Terms or your misuse of the service.

17. Changes to These Terms

We may update these Terms as Fluentide evolves. When we do, we'll update the "Last updated" date at the top of this page. For material changes, we'll give reasonable notice (for example, by email or an in-app notice). Continued use of Fluentide after changes take effect means you accept the updated Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Delaware, except where mandatory consumer-protection laws of your jurisdiction apply.
